Terms of Service

These terms are an agreement between you and Forsite, LLC, a Minnesota limited liability company ("Forsite"), for the forsite.io platform, including the rep portal, community pages, and related tools. By creating an account or using the service, you agree to these terms and the Privacy Policy. Questions: support@forsite.io.

Accounts

Sign-up asks for your first name, last name, email, and a password. You are responsible for activity under your account and for keeping the password confidential. Forsite does not offer a free trial.

Refunds and cancellation

Paid plans are billed monthly through Square. You can cancel at any time. Cancellation stops future renewals. The subscription stays active through the end of the current paid billing period. Forsite does not provide partial-month or prorated refunds. Prices shown on the pricing page are the current monthly rates unless a separate written agreement says otherwise. A dormant option, when offered, is also billed monthly.

Customer content

You keep ownership of photos, plat maps, floor plans, renderings, logos, community copy, and other material you upload ("Customer Content"). You grant Forsite a non-exclusive license to host, store, reproduce, display, and distribute that content as needed to operate the service and to show it on community pages you publish. You represent that you have the rights to upload the content and to grant this license, and that the content does not infringe anyone else's rights.

Community pages are public housing advertisements. Do not upload content that discriminates, or that indicates a preference, limitation, or discrimination, based on race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by the Fair Housing Act or applicable state law.

Buyer inquiries

If you publish a community page, buyer inquiries are delivered to the assigned rep, stored for the builder organization, emailed through Resend, and may be exported to a CRM you connect. Forsite admins can view leads to operate the service. You are responsible for how you and your organization contact those buyers, including any calls or texts.

Disclaimers

The service is provided as available. Renderings and other visuals are illustrative and may differ from a finished home. Forsite does not guarantee sales results, uptime, or that a community page will meet a particular legal or MLS requirement. To the fullest extent the law allows, Forsite disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent the law allows, Forsite is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data or goodwill. Forsite's total liability arising out of the service in any twelve-month period is limited to the fees you paid Forsite for the service during that period. These limits do not apply where the law does not allow them.

Governing law

These terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Courts in Minnesota have exclusive jurisdiction over disputes arising out of these terms or the service, except that either party may seek injunctive relief in any court of competent jurisdiction.
